Film and Video Submission Rules

 

Film’s and/or Video’s theme must adhere to the history of our region. The films/videos are limited to 5-minutes. The Festival is for a General Audience base. DO NOT SUBMIT "Mature Audience Only" material. Please consider general audience for appropriate language in your narratives.

 

The films/videos must be original and unpublished and unproduced in any type of setting or venue. Videos may contain free-ware, such as Powerpoint clipart or images which are in the public domain. Please identify your use of such visual forms.

 

Films/Videos, including any soundtracks, must not infringe any copyrights or rights of any third parties. All entrants will be required to sign the application, confirming that the film/video entry is original and that he/she holds copyrights to any visuals or sounds or songs comprising the film/video. Film/Video creators will retain copyright and full ownership of their film/videos. Center of the World Festival will not have any ownership rights to any film/video submitted. Releases and Copyrighted Material: If your film contains any copyrighted material (music for example) the filmmaker will be responsible for securing the licensing rights. (To avoid the expense and difficulty of securing such rights we recommend using only original, non-copyrighted material or material licensed under the Creative Commons Attribution-ShareAlike license).

 

The Center of the World Festival film/video contest is open to all amateurs regardless of nationality or origin. Minors (children to age 18 years) must have signed parental consent. Parent or guardian must sign the entry form and put the minor’s date of birth on the entry form. Competition is restricted to English language submissions only.

 

Collaborations are accepted. Film/Videos may have multiple co-producers, but each creator must complete an application form, referencing the shared film/video title. However, one person must be designated on the primary entry form and it is to this person that any grant prize will be awarded. The division of prizes among co-authors is the responsibility of the winners. Grant Prize is $200.  A prize is given in both categories--Youth and Ages 18+

 

There are no contractual obligations, or royalties paid to film/video producers-creators whose film/video is selected as finalist for the Festival. However, all finalists will receive a Certificate of Recognition.

 

Entry constitutes permission to use the author-creator’s name, likeness, and voice for future advertising and publicity purposes without additional compensation. You also give permission for Center of the World Festival to display the winning film for promotional purposes on its website (www.cowfest.org), on its YouTube Channel, on all of its social media sites including the website blog and FaceBook Pages and at its related events.  You also give permission for your video to be included in the Cal Humanities completed historical videography (click here for more details).

 

Film/Video submission donation: There is a suggested minimal donation of $10.00, payable by check to Center of the World Festival, Inc. Send donation with submitted films/videos. These donations are used to pay for the advertising expenses associated with conducting this Festival. No donation is expected from under-age minor applicants nor adult hardship cases.

 

To clarify some confusion over the "donation" request: As a nonprofit charity, we are always seeking donations. However, there is not an entry fee for this competition. Donations are voluntary. All submissions are accepted without donations.

 

We use a Tascam DVD player, which can play finalized discs only. These include:  DVD Video, DVD VR, DVD Audio, but does not play DVD-ROM, DVD-RAM, CD-1, Photo CD, etc.  If you submit a DVD which is not playable, we will notify you, but it is your expense if you want that DVD sent back to you.

Deadline for film/video submission is July 15, 2015. Finalists will be notified by July 30, 2015. All applicants will be notified of the results. After the film/video is accepted as a finalist, the film/video may not be withdrawn for any reason.

 

Should your film/video be selected as a finalist, you are giving the non-exclusive right to the Center of the World Festival to show the video from August 14 through August 16, 2015. 

 

All films/videos will be judged for finalist selection by the board of directors. The films/videos are judged on creativity and adherence to theme.  Chosen videos will be posted on this website:  www.cowfest.org  Voting instructions will be sent to all finalists.  By participating in the Contest you permit public voting in connection with your Entry.

 

We do not conduct, nor send, written evaluations of films/videos. At this time, we are not accepting phone calls. Agreement to Official Rules: By participating in the Contest, you fully and unconditionally agree to and accept these Rules and the decisions of the Center of the World Festival and/or judging sponsors/Administrators, which are final and binding in all matters related to the Contest. Whether or not you receive a Prize is contingent upon fulfilling all requirements set forth in these Rules. The Contest is subject to all applicable federal, state, and local laws. Contests are void where prohibited by law.

 

Rights Granted by you: By entering this Contest, you agree that the Center of the World Festival, its Administrators, and their respective licensees, successors and assigns will have the right to use all or a part of your Entry, your name and address (city and state/province/territory), and the names, likenesses, photographs, voices and images of all persons appearing in the Entry anywhere in the world and in perpetuity, for future advertising, trade, promotion and publicity in any manner and in any medium now known or hereafter devised throughout the world in perpetuity, without compensation and without notice to you and without consideration, review or approval from you; and you agree that you will not now nor in the future be paid for your Entry or for granting any of the rights set out in these Rules.

 

Your Representations and Warranties: By entering the Contest, you represent and warrant that:

 

1. your Entry, in its entirety, is an original work by you and you have not included third party content (such as writing, poetry, text, graphics, artwork, logos, photographs, likeness of any third party, musical recordings, clips of videos, television programs or motion pictures) in or in connection with your Entry without permission;

 

2. your Entry, the use thereof by the Center of the World Festival, or the exercise by the Center of the World Festival of any of the rights granted by you under these Contest Rules, does not and will not infringe or violate any rights of any third party or entity, including, without limitation, patent, copyright, trademark, trade secret, defamation, privacy, publicity, false light, misappropriation, confidentiality, or any contractual or other rights;

 

3. you have all the rights, licenses, permissions and consents necessary to submit the Entry and to grant all of the rights that you have granted to the Center of the World Festival under these Contest Rules;

 

4. all persons who were engaged by you to work on the Entry, who appear in the Entry in any manner, or have contributed to the Entry have:

 

a. given you their written consent to submit the Entry without claims for payment of any kind; and

 

b. provided written permission to include their name, likenesses, image or pictures in or with your Entry (or if a minor who is not your child, you must have the permission of their parent or legal guardian) and you may be asked by the Center of the World Festival to provide such permission in writing to it.

 

Nothing contained in these Rules shall be construed to: (i) give any party the power to direct and control the day-to-day activities of the other; (ii) constitute the parties as partners, joint venturers, principal and agent, employer and employee, co-owners or entrants in a joint undertaking; or (iii) allow you to create or assume any obligation on behalf of the Center of the World Festival.

 

By entering the Contest, you fully and unconditionally agree to and accept these Rules and the decisions of the Center of the World Festival Administrators and the members of the voting community, which are final and binding on all matters relating to this Contest.

 

Center of the World Festival reserves the right to cancel, modify or suspend the Contest at any time, if it is determined that the Contest cannot be run as originally planned or if fraud or any other occurrence comprises the fairness or integrity of the Contest.

 

Liability Provisions: The Center of the World Festival is not responsible for human error, theft, destruction, or damage to Entries or other factors beyond its reasonable control. You assume all risk of damaged, lost, late, incomplete, invalid, incorrect or misdirected Entries. The Center of the World Festival makes no warranty, representation or guarantee, express or implied, in connection with its ability to in any way enable, develop or market the idea set forth in your Entry.

 

The Center of the World Festival shall not be liable to a Winner or any other person for failure to supply the Prize or any part thereof, by reason of the Prize becoming for reasons beyond the reasonable control of the Center of the World Festival unavailable or impracticable to award, or for any force majeure event, technical or equipment failure, terrorist acts, labor dispute, or act/omission of any kind (whether legal or illegal), transportation interruption, civil disturbance, or any other cause similar or dissimilar beyond its control.

 

LIMITATIONS OF LIABILITY AND RELEASE: BY SUBMITTING AN ENTRY, YOU AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE RELEASED AND HELD HARMLESS BY YOU AND YOUR HEIRS, EXECUTORS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS FOR ANY CLAIMS, LIABILITIES, OR CAUSES OF ACTION OF ANY KIND OR NATURE FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES TO PERSONS, INCLUDING, WITHOUT LIMITATION, DISABILITY OR DEATH, AND DAMAGE TO PROPERTY, DUE IN WHOLE OR IN PART, ARISING DIRECTLY OR INDIRECTLY, NOW OR IN THE FUTURE FROM THE DELIVERY, ACCEPTANCE, USE OR MISUSE OF THE PRIZE, ANY AND ALL USE AS PROVIDED HEREIN OF YOUR ENTRY, OR PARTICIPATION IN THIS CONTEST AND/OR ANY RELATED CONTEST. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SITE AND ANY CONTEST SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
